This allows a loophole of sorts that makes Delta 8 legal federally, but marijuana illegal. Since hemp plants are low in THC, the Delta 8 chemical must be extracted for use in consumable products. 

The Importance of THC Content 

The differences in types of THC tells the story of Delta 8 and its legality. Delta 8 THC (Tetrahydrocannabinol) is almost chemically identical to Delta 9 THC, which is the chemical in the cannabis plant that creates a high and makes the plant illegal federally. 

Delta 8 products use THC extracted from the hemp plant, which is why they’re legal. While the effects of Delta 8 strongly mirror those of Delta 9, people new to the plant typically have an easier time handling Delta 8, because it’s a bit milder.
