Unfortunately, that hasn’t stopped farmers from selling to the highest bidder, and many residents are pushing for full legalization.
The argument is that recreational approval would reduce illegal trade and help farmers and the public. Regulating drug trafficking is a complex issue in Colombia and has grown to larger numbers than during the height of Escobar’s days. So, while it is legal to purchase Delta 8 in Colombia, there are more restrictions.
Recreational vs. Medicinal Cannabis Use in Colombia
Recreational use continues to be illegal in Colombia. Medicinal use also has several restrictions. As a patient, you cannot have access to raw marijuana products.
You can receive approval to grow small amounts of cannabis on your property. However, it cannot be sold or given to others.
Any breach is considered a criminal offense in Colombia. Typically, cannabis consumption for recreational use is not punished. However, any importation, exportation, or illegal production is punishable.
Other cannabinoids like CBD can be used in products like cosmetics or supplements. The most recent legislature proposed legalizing cannabis and other drugs, like cocaine. Most suspect it won’t pass any time soon.
What Is Delta 8?
Delta 8 is a naturally produced cannabinoid. Since it only occurs in small amounts, most delta 8 products are synthetically created. Delta 8 products are primarily derived from the hemp plant.
What makes it different from other THC products? Delta 9 is the main marijuana product that most think of when smoking weed.
The two differ slightly in their genetic makeup. Because of these small differences, delta 8 tends to produce less of a high than other cannabis substances. Delta 8 falls between CBD and delta 9 in terms of psychoactive effects.
Delta 8 vs. CBD in Colombia
Like in the United States, the legality of Delta 8 is convoluted. On one end, Delta 8 is derived from hemp products. By definition, hemp contains less than 0.3% THC or delta 9.
In the United States, hemp became legalized in 2018. Since hemp products like CBD are legalized in Colombia, you could argue that delta 8 is as well. Purchasing and using delta 8 recreationally can still put you at risk of breaking the law.
Purchasing Delta 8 for Medicinal Purposes
Delta 8 can be used for medicinal purposes. Beginning this year, every insurance provider in Colombia must cover medicinal THC products.
This has lowered the costs substantially for residents looking at delta 8 for medicinal purposes. Other legislation changes made it easier for residents to:

- Simplify forms
- Decrease approval waiting times
Experts estimate that around 97% of Colombia residents are now covered for medicinal marijuana under these new laws. To get started with purchasing delta 8 for medicinal purposes, you will need a license. There are two government institutions where you can purchase a cannabis license:
- Ministry of Health and Social Welfare
- Ministry of Justice and Law
License durations are around five years or less if you are a foreigner. If you are traveling to Colombia under a visa, the medical marijuana license is valid for the term of your visa.
There are also exclusive licenses for hemp production. This license is for Non-Psychoactive Cannabis Plants Cultivation.
In Colombia, hemp products must contain less than 1% THC and could include delta 8 products. Lastly, you may also need proof of residency and income before starting.
How To Use Delta 8
Delta 8 has many different forms. While you can smoke or vape delta 8, it can irritate your lungs and airway. If you prefer smoking or vaping, start with a smaller dosage since it can make you feel lightheaded or dizzy. Tinctures and edibles are two other options.
Tinctures are often used sublingually and are an easy way to consume delta 8. Edibles can be delicious and are easy to control the dosage.
You may also notice fewer side effects compared to smoking, but you should always monitor your reactions in a safe environment when you first start. Some of the side effects you could experience:
